Contest Rules


1. Eligibility: This Contest is intended for participation by legal residents in the 50 United States of America, APO/ FPO military addresses, District of Columbia, and U.S. territories including: American Samoa, Guam, Northern Marianas Islands, Puerto Rico, and Virgin Islands, and shall be construed and evaluated according to the laws of the 50 United States, District of Columbia and mentioned territories.

Do not enter the contest if you are not a resident of one of the 50 U.S., D.C. or one of the U.S. territories. Manufacturers or their officially appointed reps/distributors are eligible to enter the products. All parties entering products must meet the eligibility requirements set forth herein. This Contest is subject to all applicable federal, state, commonwealth, territory and local laws and regulations. Void where prohibited.

Products entered in the Contest must be manufactured in the USA with two noted exceptions: a: Products that were Invented in the USA by a legal US resident, with the Inventor (or his/hers direct heirs) currently running the company in the USA and receiving income derived from the Product. These Products must, and can only be, entered in the ‘Hot Product’ category. b: The product is an Invention and not being manufactured yet. Inventions are to be entered only in the ‘Invention’ product category.  We recommend that these inventions are in the final Prototype stage and ready to manufacture. See Item #4.

For the purposes of this contest any person, team or group manufacturing a product from home, garage or small shop will be considered a manufacturer and eligible to enter the Contest.

2. Contest Period: Starts June 1, 2012 at 12:00 AM Central Standard Time ("CST") and ends December 31, 2012 at 11:59 PM CST (the "Contest Period"). (Entry deadline extended to June 31, 2013) To enter, visit (the "Website") during the Contest Period. (We have extended the voting period for the Made in America – Hot Product Contest until December 31st, 2013)

3. Creating a Manufacturers Profile and Entering a product in the Contest confirms that you and all parties with a vested interest in the product have read and accepted these Official Rules.

4. Inventors Warning. The contest is for people that have already obtained a patent or are similarly protected, and are not worried about thousands of people seeing their product, as this year the public will be voting for the products. We advise that your product should be in low volume production or in final prototype stage, and you are looking for public comments and possible licensing deals. Your product should only be entered under the category of ‘Inventions.’

5. How to enter your product. Click on the banner that says; ‘Submit Your Products’ on the right side the home page. Fill out the Manufacturers Profile to create your account. You will receive an email to verify the creation of the account. After verification you will be able to enter products from your profile page, also called your ‘Dashboard.’

NOTE: It is highly advised that and have a YouTube account and a video of your product at the time of entry so you can post the video on the contest site. If you do not have a YouTube account, you can create one for free at; visit  A picture of your product and description is required at a minimum.

The process to enter your products should be self explanatory and easy to follow. You will be able to edit your entry at a later time if needed from your accounts ‘Dashboard.’
To upload a picture of your product you will need to know where the picture is located on your computer.

To upload your video from YouTube, you only need to enter the videos ID# found in the URL.

On the entry form you will see a field called: ‘YouTube video ID here:’

The Product featured in the Entry by Entrant shall be referred to herein as the "Product." The video clip shall be referred to herein as the "Video." The "Entry" shall include your entry form, the Video, Picture and description of the Product.

There is no limit to the number of unique Entries that a single manufacturer can submit during the Contest period, but each product can only be entered one time. Each product entered that uses a YouTube video will be subject to the Terms Of Use found at and must comply with all Submission Requirements and may be screened by the NMOA for compliance with these Official Rules. NMOA's decisions with respect to whether an Entry complies with these Official Rules are final and binding.

If a product is submitted by a manufacturer’s rep, the rep will be the individual designated for Contest contact purposes. The manufacturer’s rep is responsible for submitting the Entry on behalf of the manufacturer and shall make available from the manufacturer’s officer(s) written authorization giving permission for rep to submit said product on their behalf, if so requested by the NMOA.

The Entrant must hold all rights, title, and interest in the product (as more completely set forth below). You may be required to provide documentation in a form acceptable to NMOA evidencing such rights and interest if so required by NMOA. Entry may be screened by a representative of the NMOA for compliance with these Official Rules before, during or after the Contest and before any awards or prizes are issued.

Entries will be posted at in accordance with the contest schedule set forth below. NMOA has the right to not post, or remove any Entry that does not appear to be in compliance with these Official Rules, as determined by NMOA in its sole discretion.

Entries generated by script, macro or other automated means or by any means which subvert the entry process are void. Entry constitutes your consent to participate in this Contest and consent for NMOA to obtain, use, and transfer your name, address, and other information for the purpose of administering and promoting this Contest.

By submitting an Entry, you warrant and represent that (a) you have all rights, including, without limitation, rights of copyright, trademark and other intellectual property rights, to the Product, Images, and Video to submit your Entry in accordance with these Official Rules, subject to the posting and voting provisions herein.

(b) your Entry does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity (as more fully set forth in the Submission
Requirements below),

(c) that publication or other use by NMOA of the Entry via various media including Web posting, will not infringe on the rights of any third party rights; and (d) otherwise complies with these Official Rules. You will indemnify and hold Released Parties (as defined below) harmless from and against any and all claims to the contrary and any demands, actions, causes of action, damages, costs or expenses brought against or suffered or incurred by the Released Parties, or any of them arising out of or in connection with your participation in this Contest, or the use, in whole or in part, by any Released Party of your Entry (or portion thereof) submitted by you in this Contest.

As conditions of Contest entry, you acknowledge and understand that NMOA, co-sponsors, and other participants and members of the general public have access to viewing all contest Entries and agree to hold harmless NMOA and all contest co-sponsors for any person or company that may create materials, ideas and concepts which may be similar or identical to your Entry. This is a public contest!

5. Submission Requirements: All Entries must meet the following requirements to be eligible:

The Entry may not contain any content that is lewd, obscene, discriminatory, sexually explicit, pornographic, disparaging, defamatory, libelous, obscene, or that otherwise contains inappropriate content or objectionable material as determined by NMOA in its sole and unfettered discretion.
The Entry must not infringe the copyright, trademark, privacy, publicity, or other intellectual rights of any person or entity.
If any persons appear in the Entry, you are responsible for obtaining, prior to submitting the Entry, any and all releases and consents necessary to permit the exhibition and use of the Entry by NMOA as set forth in these Official Rules. If any person appearing in any Entry is under the age of majority in their state, the signature of a parent is required on each release.
Should you include personally identifiable information about yourself in your Entry, you acknowledge and agree that such information will be disclosed publicly and you are solely responsible for any consequences thereof. If the entry contains personally identifiable information of any person other than yourself, you are responsible for obtaining, prior to sending the Entry, such person's written consent to include their personally identifiable information in the Entry in accordance with these official rules. If any such person is under the age of majority in their state, the signature of a parent is required on each such consent.

You may not be, nor may you work with parties in conjunction with your Entry, who: 1) are represented under contract (e.g., by a talent agent or manager) that would limit or impair NMOA's ability to display the Entry in any media form; 2) have an acting or modeling contract that would make their appearance in the Submission a violation of any third party rights; or 3) are under any other contractual relationship that may prohibit you from participating fully in this Contest, or from allowing NMOA to use royalty-free, the Entry worldwide in all media in perpetuity.
You must own or have all rights to the commercial content or logos in the Video, Pictures and on the Product and have the all rights to submit the Entry in accordance with these Official Rules.
The Entry may not contain any material or elements that are not owned by you and/or which are subject to the rights of third parties.

Each product is required to pay a $30.00 entry fee.
Entries that are not compliant with these Official Rules will cause the Entry to be void, at the discretion of the NMOA.

6. LICENSE TO VIDEOS: By submitting an Entry, Entrant hereby grants to NMOA, and to its licensees, successors and assigns, and any person or entity acting on its behalf, the irrevocable right and license to use, publish, exploit, modify, edit, transmit and distribute the Video submitted as the Entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or hereafter devised, worldwide, in perpetuity for NMOA's advertising and promotional purposes without compensation, permission or notification to Entrant or any third party. Entrants maintain ownership of the Video and therefore, have the right to promote such Video to gain votes before and during the Voting Period, provided such promotion is conducted in a lawful manner.

7. Public Voting Period: The Public Voting Period will be from June 1, 2012 until January 31, 2013.

The Entry receiving the highest number of votes in each product category will be deemed the winner of that category. In the event of a tie by number of votes, the product with the highest average ranking will be named the winner. In the event of a tie of both votes and star based ranking, a coin toss or other suitable means determined by the NMOA will establish the winner. Each winner must have a minimum of 100 votes.

Award/Prize winners.

NMOA reserves the right to not name a winner in a product category it does not receive a sufficient number of eligible and qualified Entries.

Public Voting - The public will be provided with the opportunity to visit the Website at and register to be a voter and subsequently vote for his/her favorite products (each a "Vote") using a 1-5 star ranking system, and subject to the Voting Terms outlined below. A ‘1’ star vote is still a positive vote for a product. Voters may vote for any product they wish, and for as many different products they wish, but can vote only ‘one time’ per product.

Registered voters will have a private Voter Account they can log into that keeps track of all the products they voted for. This area is called a ‘Dashboard.’

Entrants are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering Prizes or other inducements to members of the public, as determined by NMOA in its sole discretion.

Votes generated by script, macro or other automated means or which subvert or impair the integrity of the voting process will be void. Any attempt by Entrant and/or his/her family/friends or any other individual to vote using any fraudulent mechanism, as determined by NMOA in its sole discretion, shall give NMOA the right to void the votes in question and/or disqualify the Entry in its sole discretion.

8. Award/Prize Winner Verification: Before being named a winner, an entered product is subject to verification of eligibility and compliance with these Official Rules prior to receiving Award/Prize. The Potential Winner may be subject to an interview by NMOA to help ensure his/her product complies with the Official Rules, and they may be disqualified if the product is not in compliance with these Official Rules, as determined by NMOA in its sole discretion. Potential Winner may be required to provide proof (to NMOA's satisfaction) that he/she owns all rights to the Entry. Failure to comply with any of these requirements may, at NMOA's sole discretion; result in disqualification and an alternate Winner may be notified.

9. Awards/Prizes: Awards will be given to one (1) winner in each of the product categories. Additional prizes may be added during the term of the contest.

Products ranking high may also have the opportunity to be sold in various retail outlets. As well as being offered manufacturer rep agreements.

All other costs and expenses associated with acceptance and use of any prize or award not specifically mentioned herein as being provided herein are solely the responsibility of the Award/Prize winner.

Awards/Prizes are not transferable and must be accepted as awarded, with no substitutions of any kind. All federal, state and local taxes, if any, as well as any other costs and expenses associated with Award/Prize acceptance and use not specified herein as being provided are the Winner's responsibility. All taxes are the sole responsibility of the Company. All Awards/Prizes are at the NMOA's sole discretion.

10. Winner Announcement and Award/Prize Notification: Potential Winner will be notified via email within three (3) calendar days after winner determination in February 2013. Notification will be sent to the email address provided at time of entry. It is the Entrant's sole responsibility to ensure that the email address is functional and is a valid email address, and to configure his/her spam filters as necessary to ensure prompt receipt of NMOA messages. These include:,,  NMOA is not responsible for any change in Entrant's email address or other contact information.

Potential Winner will be required to execute/sign and return an Affidavit of Eligibility, a Liability Release, a Publicity release confirming acceptance and compliance with these Official Rules and return same within (5) calendar days of date of notification, otherwise the Potential Winner may forfeit the Award/Prize which may then be awarded to the applicable runner-up, at NMOA's discretion.

Manufacturer’s rep must be authorized by the manufacturer to sign the affidavit and releases. If manufacturer’s rep fails to comply within this time period, the product may be disqualified.

If a Potential Winner is found to be ineligible or not in compliance with these Official Rules, declines to accept a Award/Prize, or NMOA is unable to contact a Potential Winner within a reasonable period, or in the event that a Award/Prize notification is returned undeliverable, the Award/Prize may be forfeited and, at the NMOA's sole discretion, Award/Prize may be awarded to the applicable runner-up Potential Winner, if time permits, who may be required to furnish proof of identification.

NMOA shall not be held responsible for any delays in awarding of the Award/Prize for any reason. Award/Prize will only be awarded only to verified Winner.

By accepting an Award/Prize, Winner consents to the use of his/her name, address (city and state), voice, statements relating to the Contest or NMOA, and photographs or other likenesses, and Entry without further compensation, notification or permission in any publicity, promotion or advertising carried out by NMOA or any related entities in any and all media now known or hereinafter developed without territorial or time limitation, except where prohibited by law.

11. Conditions of Entry: You agree to these Official Rules and the decisions of NMOA, which are final and binding in all matters. You agree on your behalf, and on behalf of your respective heirs, executors, administrators, legal representatives, affiliates, successors and assigns (collectively, "Releasing Parties"), to release, defend and hold harmless the Contest Entities, YouTube, its parent corporation, affiliates, officers, directors, employees and agents (collectively, "Released Parties") from any and all actions, causes of action, damages, losses, and expenses (including reasonable attorneys' fees) claims and demands whatsoever, in law, admiralty or equity, whether known or unknown, foreseen or unforeseen, against the Contest Entities which any one or more of the Contest Entities ever had, now have or hereafter can, shall or may have which in any way arise out of or result from your participation or acceptance and use or misuse of Award/Prize, including any Contest activities. You assume all liability for any injury, including death or damage caused or claimed to be caused, by participation in this Contest or use or redemption of any Award/Prize. This Contest shall be governed by and interpreted under the laws of the State of Minnesota , U.S.A. without regard to its conflicts of laws provisions. Venue for all suits will be in Minneapolis, MN U.S.A.

You agree that: (a) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental, consequential, or any other damages, including without limitation, actual out-of-pocket expenses; and (b) all causes of action arising out of or connected with this Contest, or any Award/Prize awarded, shall be resolved individually, without resort to any form of class action. Contest Entities are not responsible for lost, delayed, misdirected, inaccurate, garbled, stolen, incomplete, or late submissions.

Proof of transmission (screenshots or captures of submission, etc.) does not constitute proof of delivery. NMOA reserves the right, in its sole discretion, to void any and all Entries of an Entrant who NMOA believes has attempted to tamper with or impair the administration, security, fairness, or proper conduct of this Contest.

NMOA reserves the right, in its sole discretion to terminate, modify, cancel or suspend this Contest at any time and for any reason, including, but not limited to, fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes corrupt the administration, security, integrity, or proper participation of the Contest and, if terminated, distribute the Award/Prizes from among all eligible, non-suspect Entries received up to time of cancellation using the voting procedure outlined above.

 NMOA further reserves the right to extend the end date of the Contest in its sole discretion. If NMOA determines in its sole discretion that the manufacturer or any officer, director, employee or other representative of the manufacturer has attempted to undermine the legitimate operation of this Contest, Company may be disqualified, as determined within NMOA's sole discretion.

12. Contest operation: Released Parties do not warrant that access to the Contest will be uninterrupted. Released Parties are not responsible for any problems that may arise, including but not limited to;
(a) lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, Web sites, or other connection, availability or accessibility problems arising in connection with or over the course of the Contest; or
(b) communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; or
(c) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error; or
(d) for any other errors or problems of any kind relating to or in connection with the Contest, whether human, mechanical, clerical, electronic, or technical in nature, including without limitation, any error or problem in connection with the administration of the Contest, the processing of Entries or votes, the administration by the NMOA, the announcement of the Award/Prizes or in any Contest-related materials, or
(e) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Contest; or
(f) damage to a user's system occasioned by participation in this Contest or downloading any information necessary to participate in this Contest.

13. Disclosures: Any attempt by an Entrant or other individual to deliberately damage any website or undermine the legitimate operation of this Contest, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, NMOA reserves the right to seek remedies and damages (including attorneys' fees) from any such individual, to the fullest extent permitted by law, including criminal prosecution. Entrant engaging in any of the foregoing activities may be disqualified, all associated Entries and/or votes may be void and may forfeit any Award/Prize won.

14. In the event of any conflict with any Contest details contained in these Official Rules and Contest details contained in Contest materials (including but not limited to newsletters, television and print advertising, and other promotion media), the details of the Contest as set forth in these Official Rules shall prevail.

This Contest is sponsored by NMOA (2807 Polk St. NE, Minneapolis, MN 55418). YouTube is not a sponsor of nor is it affiliated in any way with this Contest.

Voting Terms and Conditions

All eligible Entries will be posted on (the "Website"). Voting will be open in accordance with the following schedule giving a fair opportunity for each registered voter to vote for his/her favorite Entry.

June 1, 2012 to January 31st 2013.

Voters can vote for any product entered in the contest.
Voters can only make one vote per product. (Voters must register to vote and will need to provide their name, email address, and zip code. This will help secure the system from people stuffing the ballet box with more than one vote.)
Voters will rank the products they vote for on a scale of 1-5 stars.
Voters can make comments about the product and this is highly encouraged.
Voters are asked to choose a Retail Price they would expect to pay at the store.
Voters can request to sell the product in their stores.
Voters can view products by category, by unique ID number, or simply viewing products page by page.
Voters that want to help a specific product get additional votes can share the unique ID number for the product with their friends and networks.

Voters must follow instructions on Site to submit their votes. Payment or other consideration in exchange for votes is prohibited. Voters may vote for as many different Entries as they wish, however, they may only vote once per Entry.

Votes must be entered manually. Votes generated by script, macro or other automated means or any other means intended to impact the integrity of the voting process as determined by NMOA are void. Any attempt by Entrant and/or his/her family/friends or any other individual to vote using multiple names or email addresses and/or any other fraudulent mechanism, as determined by NMOA in its sole discretion, shall give NMOA the right to void the votes in question and/or disqualify the Entrant in its sole discretion.

NMOA, its affiliates, co-sponsors, supporters, subsidiaries, consultants, agents, promotion agencies and suppliers, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, "Released Parties") are not responsible for incorrect/inaccurate voting information.

 Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, votes. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any vote to be cast or tabulated on account of technical problems, human error or traffic congestion on the Internet or at website, or any combination thereof or for any other reason, or for any injury or damage to participant's or any other person's computer relating to or resulting from participation in voting process or downloading any materials. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE VOTING PROCESS OR THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, NMOA RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

NMOA reserves the right, in its sole discretion, to modify, terminate, or suspend the voting or void any vote should a virus, bug, non-authorized human intervention, action of Entrant or voter, or other cause corrupt or impair the administration, security, or fairness of the voting. NMOA reserves the right, in its sole discretion, to disqualify any individual they find to be violating these terms, tampering with the voting process, or acting in an unsportsmanlike or improper manner and void all associated votes. If the voting process is terminated early by NMOA, NMOA reserves the right to count the eligible votes among all non-suspect, eligible votes received up to time of cancellation.

The decision of the NMOA with respect to the tallying of votes, and the invalidation or disqualification of any suspected votes, shall be final and binding. Voting in the Contest is subject to all applicable federal, state, and local laws and regulations.
